WA Courts During COVID-19 Lockdown
As of yesterday evening, His Honour Chief Justice Quinlan advises: "All trials and substantive in-person hearings listed during the week beginning 1 February 2021 in the affected regions (Perth, Peel, South-West) will be vacated, unless alternative arrangements are expressly made for them to continue. This includes all jury trials." And: “Each court will determine whether other in-person hearings (including mediations) listed for 2 February to 5 February will proceed as listed. Whether that occurs will depend upon the availability and suitability of a remote hearing, the urgency of the matter and the personal circumstances and availability of the parties and their representatives. Such arrangements should be made with the individual court or tribunal concerned.” Courts sitting around the rest of WA continue as normal. Lawyers have been advised to provide the court with telephone contact numbers. The delay to commencing jury trials will put pressures on an already stretched court trial timetable. Available times to re-schedule jury trials are almost non-existent until 2022. It will be interesting to see how the courts handle the situation.
